A proposed pesticide remedy
The Federal Trade Commission and state partners on September 28 announced a proposed resolution with Corteva in their pesticide-distribution antitrust case. The package would restrict specified loyalty arrangements for ten years and provide $35 million to participating states. The agency described restrictions intended to give distributors more freedom to buy competing generic pesticides. The stipulated order requires a judge's signature to become enforceable; this article does not assume that court entry had occurred by the publication cutoff. Litigation against Syngenta continues. What would change in distribution
The proposed terms target incentives connected to distributors' purchases, including arrangements that condition benefits on buying more than half their requirements from Corteva or restrict their generic purchases within specified limits. The practical issue is market access after patent protection ends: a generic supplier may have a lower price yet struggle to reach farms if distribution economics discourage stocking it. Whether the proposed remedy ultimately changes prices or market shares will require later evidence. The announcement itself does not measure savings already received by farmers. [1]
Booking adjusts platform rules
A European Commission September 28 factsheet described Booking.com's changes following Digital Markets Act compliance discussions. Among them, external prices would no longer determine eligibility for its Booking Sponsored Benefit program, alongside greater transparency around ranking-related programs for accommodation providers in the European Economic Area. The document is a compliance update, not a new monetary fine or a court judgment. Money is not the only remedy
The U.S. Justice Department on September 29 filed a statement of interest concerning proposed settlements in meatpacking-worker antitrust litigation. The department urged the court to withhold final approval, arguing that proposed monetary relief did not include measures adequate to prevent recurrence of alleged wage-fixing and compensation-information sharing. The government's filing is a position in litigation, not a judicial finding resolving the allegations. Its focus adds a useful distinction to settlement reporting: damages for past conduct and restrictions on future conduct perform different functions. [3]
Adviser referrals draw an SEC settlement
The SEC on September 28 announced settled charges against Zoe Financial over disclosure of conflicts in its adviser-referral business. The agency's order describes financial incentives associated with the Zoe Wealth service and salespeople's role in supplementing algorithmic matches. Zoe agreed, without admitting the findings, to a cease-and-desist order, censure and $450,000 civil penalty. The release also acknowledged remedial measures. A referral system's software design and the incentives surrounding human recommendations are separate parts of the same disclosure question. [4]
Supervisors look inside credit models
The Bank of England's Prudential Regulation Authority published September 30 feedback on IFRS 9 expected-credit-loss accounting. Its letter discusses data, model risk and adjustments, and signals further work seeking auditors' views on private-credit exposures in 2027. That planned work is not a finding that particular private-credit positions are impaired. The current development is supervisory attention to how institutions identify exposures and estimate losses, especially where structures are complex or timely information is difficult to obtain. [5]
